Guidelines

Content:
Commercial spots can be informational, funny, sad, personal, musical; clips of home movies, pastiche of footage--whatever else you prefer. It can be shot or taped in any format, such as digital video, film, etc., so long as the final version of the spot is broadcast quality.

Here's an EXAMPLE of text or voice-over that can be used in an commercial spot:

I do vote.
I do have a family.
I do pay taxes.
I don't have equal rights.
I don't have equal protection under the law

A few things to keep in mind:

  • Purpose. Commercials should communicate to a general public audience and be suitable for submission to major network and cable television stations.

  • Language. English-language is preferred. Spanish language is also acceptable and an English-language script (print out) must accompany your submission. If your ad is selected as the winner, please have on hand a version with visuals only (without audio and without text graphics). The final version will be modified by GLAAD and broadcast in English, while the original spot will be used in its target language market.

  • Profanity or Nudity. Submissions that include profanity or nudity will be automatically disqualified.

  • Partisan Politics. As a charitable, 501(c)(3) organization, GLAAD cannot participate in any partisan activities. For that reason, submissions must not directly or indirectly refer to any politicians, candidates (including President Bush) or parties. Any submission that does so will be automatically disqualified.

Submissions & Format:
You can submit your commercial spot to GLAAD from March 27 to July 1, 2004 by 6 p.m. PST.

All final spots should be NTSC and should be submitted to GLAAD in one of the following formats:

  • VHS
  • MiniDV (tape)
  • DVD
  • CD-Rom (AVI or Quicktime)
  • Beta or Beta SP (Analog)

We will not accept DVCAM and DigiBeta. Please retain a copy of your spot, as submitted material will not be returned. Also, you must retain a copy of your video track without sound or text graphics and a copy of your audio track with all audio (voices, sound effects) but without music.

Judging Criteria:
Finalists will be selected by members of the GLAAD Media Awards voting body.

Celebrity judges will then evaluate finalists on the following criteria to determine a winner:

  • Overall Impact: educational, persuasive, informational (weighted 40%);
  • Originality: concepts/ideas/format (weighted 20%);
  • Memorable Content and Delivery (weighted 20%); and,
  • Clear Message (weighted 20%)

Who can participate:
Anyone over 15 years old who is a US citizen or resident alien living in the U.S.

Length:
A commercial spot must be no longer than 30 seconds.

Respect for Existing Copyright:
You must be the original author of everything in your commercial spot, including music, or have written permission to use all material.

Consent from Actors in Your Commercial spot:
You must include a GLAAD Talent Release for each actor or other person who appears in your commercial spot. The release must be signed by the actor(s) or other person(s) appearing in your spot. Also, any actors under 18 must include their parent or guardian's name and signature on the release form. The release form must name or describe the actor's role, so that GLAAD is able to correlate each release form with each person on-screen, if necessary.


Rules

OFFICIAL RULES
Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. The GLAAD "I DO" Contest. Contest is managed and run by the Gay & Lesbian Alliance Against Defamation (GLAAD), a nonprofit organization, headquartered at 5455 Wilshire Blvd., Suite 1500, Los Angeles, CA 90036 USA ("GLAAD").

(1) Eligibility:
Contest is offered only to natural persons older than 15 years of age as of the date of entry, who are U.S, citizens or resident aliens living in the U.S. and who must never have been charged with a felony or misdemeanor other than minor traffic violations. Employees, independent contractors, officers, and directors of GLAAD, its affiliates, subsidiaries, advertising, promotion and fulfillment agencies, legal advisors and celebrity judges and the immediate family members, domestic partners and persons living in the same household of such persons, are not eligible to participate in the Contest. Contest offered only in the 50 United States and the District of Columbia. Void where prohibited by law.

(2) How to Enter:
Create your own "I DO" commercial spot and submit it to GLAAD. Entries may be any form of moving image, including but not limited to, video, film, animation, text and audio. The final version submitted to GLAAD must be NTSC and submitted in the following formats: VHS, MiniDV (tape), DVD, Beta or BetaSP (analog) or CD-Rom (AVI or Quicktime) formats. Duration of entry cannot exceed 30 seconds. Both audio/visual and visual only entries are permitted. Only one entry is permitted per entrant.

To be eligible for entry in the Contest, complete entries, together with a fully completed and signed Submission Form, must be received by GLAAD by 6:00 p.m. PST, July 1, 2004. Late or incomplete entries are not eligible. GLAAD encourages you to use a trackable method of mail, such as Express Mail, FedEx, UPS Air, etc.

Entrant must be the sole author and copyright owner of the entry, or entrant must have written permission to use or incorporate any and all entry portions authored or owned by third parties. Materials that infringe on the rights of any party may not be used. Entrants must abide by all applicable laws.

The entry must include GLAAD's Talent Release for each actor or other person who appears in your commercial spot. The release(s) must be signed by the actor(s) or person(s) appearing in the spot. All actors under 18 must include their parent or guardian's name and signature on the release form.

GLAAD is not responsible for late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries. Incomplete or illegible entries are not eligible.

All entrants must grant to GLAAD a nonexclusive license throughout the world in perpetuity to copy, reproduce, display, or distribute the entry, and to make derivative works based upon the entry or a substantial portion of the entry without attribution or prior permission in any and all media now known or hereafter devised.

(3) Prize:
GLAAD intends to air the winning entry, or derivative work of the entry, as part of a television advertising campaign funded by GLAAD. Winner will receive a videotape of the ad, as aired, for entrant's private use. No failure to air such commercial spot or furnish said videotape shall be a breach.>

(4) Winner:
A panel of celebrity judges will select a winner from the finalists based on the following criteria:

  • Overall Impact: educational, persuasive, informational (weighted 40%);
  • Originality: concepts/ideas/format (weighted 20%);
  • Memorable Content and Delivery (weighted 20%); and,
  • Clear Message (weighted 20%)

The judges' decisions are final. Selections of winner(s) shall be made based on the foregoing criteria and/or other criteria that may be subjective. GLAAD reserves the right to disqualify and remove from the web site any entry which is, in GLAAD's or the judging panel's sole discretion, inappropriate, offensive, defamatory, or demeaning to GLAAD's reputation or goodwill or otherwise not in strict compliance with the Contest Rules. GLAAD reserves the right of the judges to select multiple winners or no winner. GLAAD also reserves the right to select the celebrity judges.

Winner will be notified by e-mail, express mail and/or phone on or about July 31, 2004 and shall be required to complete an affidavit or declaration of eligibility, a liability release and, except where prohibited, a publicity release and such other documents as may be required by GLAAD from time to time to evidence, maintain, protect, enforce and/or defend its rights with respect to this Contest (including without limitation, its right to air and use the winning entry at its sole discretion). Upon GLAAD's request, all entrants agree to sign any additional releases or authorizations that GLAAD in its sole discretion deems necessary or desirable.

Required documents must be signed and received within seven (7) days of the date printed on the prize notification. Failure to comply with or return of any prize notification as undeliverable may result in forfeiture of prize and selection of another entrant as the winner. A parent or guardian of a winner not of the age of majority in state of residence will be required to ratify and sign required documents. GLAAD is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify winners.

Participating in the contest constitutes permission (except where prohibited by law) to use name, hometown (including state), voice and/or likeness for promotional purposes in perpetuity in any and all media now known or hereafter devised without further compensation. No entries will be returned. Entrants acknowledge that all materials, including written materials and audio-visual materials submitted to GLAAD may be used by GLAAD in any manner and media. GLAAD is not responsible for lost or stolen materials.

GLAAD intends to post the name of the winner on its web site www.glaad.org after July 31, 2004.

(5) General Terms and Conditions:
By participating, entrants agree that the Released Parties (as defined below) are not responsible or liable for, and shall be released and held harmless from: (i) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties, acts of nature of force majeure of any kind; (ii) any condition caused by events beyond the control of GLAAD that may cause the Contest to be disrupted, corrupted or terminated; (iii) any printing or typographical errors in any materials associated with the Contest; (iv) any and all losses, damages, rights, claims and actions of any kind in connection with or resulting from participation in the Contest, or acceptance of the prize, including without limitation, claims based on publicity rights, defamation, or invasion of privacy.

GLAAD reserves the right, in its sole discretion, to suspend or cancel Contest at any time. All dates and deadlines are subject to change at any time at GLAAD's sole discretion. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any participant and GLAAD in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of California. The state and federal courts located in Los Angeles County, California, shall have exclusive jurisdiction over all disputes arising out of or from or under the Contest, the Official Rules, the Guidelines of any entry. Under no circumstances will any entrant be permitted to obtain an award for, and entrant hereby waives all right to claim punitive, incidental, and consequential damages.

"Released Parties" means: (a) GLAAD, its advertising, promotion and fulfillment agencies, broadcasters and distributors of the entrant's ad; (b) the parents, affiliates, and subsidiaries of the foregoing; (c) the shareholders, officers, directors, employees, independent contractors, agents, representatives and legal advisors of any of the foregoing entities listed in clause (a) or (b); and (d) the selection committee and judges of the Contest.

(6) DCMA CLAIMS:
GLAAD complies with the provisions of the Digital Millennium Copyright Act (DMCA). In compliance with the DMCA, a Designated Agent has been established with proper documentation sent to the US Copyright Office.

If you have a concern regarding the use of copyrighted material on any site on the GLAAD.org network, please contact the agent designated to respond to reports alleging copyright infringement.

The designated agent for GLAAD to receive notification of claimed infringement under Title II of the DMCA is: John Sonego c/o GLAAD, 5455 Wilshire Blvd., Suite 1500, Los Angeles, CA 90036.

The DMCA specifies that all infringement claims must be in writing (either electronic mail or paper letter) and must include the following:
A physical or electronic signature of the copyright holder or a person authorized to act on his or her behalf;
A description of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
A description of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit the service provider to locate the material;
Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic mail address;
A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
